Introduction Historically, the protection of endangered and threatened species has been the province of the federal government. In recent years, however, many states have enacted endangered species protection laws, and expanded the mandate of state fish and wildlife management agencies to encompass non-game species, including endangered species. Nonetheless, the federal Endangered Species Act ("ESA" or "Act") remains the focus of endangered species protection in the United States, and since such protection frequently implicates water resource management, it is appropriate to ask how well the current federal regime for managing endangered species comports with the Park City Principles.
